KEEPY® is a registered trademark of Human Interaction, Inc.
Human Interaction, Inc. (“Human Interaction”, “KEEPY”, “We”, “Us”, the “Company”, or the “Manufacturer”) designs and manufactures KEEPY identification tags that contain a unique QR code and identification number and are intended to be linked to a user account (the “Product”).
The Company operates mykeepy.com (the “Website”), through which tag owners may record and manage the information associated with their tags and control what information is displayed when a tag is scanned or its unique identifier is entered, and engages with users through its social media pages (collectively, the “Services”).
This Limited Warranty applies to the physical Product. Use of the Website and Services is subject to the Company’s Terms of Service, Privacy Policy, and any applicable additional policies posted on the Website.
STANDARD ONE-YEAR LIMITED MANUFACTURER WARRANTY
The Manufacturer warrants that the Product will be free from defects in materials and workmanship under normal use and conditions for a period of one (1) year from the original purchase date.
During the warranty period, and subject to verification of the defect and proof of purchase, the Manufacturer will, at its sole discretion, replace the defective Product with a new or refurbished Product of equal value. Shipping and handling fees may apply unless otherwise stated.
This Limited Warranty applies only to the physical Product and does not cover any software, websites, user accounts, or services associated with the Product.
WHAT THIS LIMITED WARRANTY DOES NOT COVER
This Limited Warranty does not cover:
(a) damage resulting from misuse, abuse, negligence, accidents, or use of excessive force;
(b) damage resulting from improper care, maintenance, or handling;
(c) normal wear and tear;
(d) damage caused by unauthorized modifications or alterations;
(e) damage occurring after delivery, including damage caused during handling or transportation by the customer or third parties;
(f) any Product that has been used, altered, or previously displayed;
(g) dissatisfaction due to buyer’s remorse;
(h) damage caused by environmental factors, including exposure to water, heat, cold, or other outdoor conditions beyond normal use.
DISCLAIMER OF WARRANTIES
Except as expressly stated in this Limited Warranty, the Product is provided “as is.” To the maximum extent permitted by applicable law, the Company disclaims all other warranties and conditions, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
For transactions occurring in the United States, any implied warranties that cannot be disclaimed are limited in duration to the one (1) year warranty period described above.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Product or the Services, including but not limited to loss of data, loss of use, or loss of value.
Some states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
INTERNATIONAL CONSUMER RIGHTS
If you purchased the Product outside the United States, you may have certain rights under local consumer protection laws that cannot be excluded or limited. Nothing in this Limited Warranty is intended to exclude, restrict, or modify any mandatory consumer rights provided under applicable local law.
HOW TO MAKE A WARRANTY CLAIM
If you believe that your Product has a manufacturing defect covered by this Limited Warranty, please contact us at team@mykeepy.com and include the following information:
a brief description of the issue;
clear photographs showing the alleged defect; and
your order number or other proof of purchase.
Claims must be submitted within one (1) year from the original purchase date. Upon receipt of a complete claim, the Company will review the information provided and, if the claim is approved, provide further instructions. Please do not send the Product back unless and until you receive confirmation from us.
If a claim is determined to be valid, the Company will, at its discretion, replace the defective Product with a new or refurbished Product of equal value.
This Limited Warranty gives you specific legal rights, and you may also have other rights that vary depending on your state or country of residence.
